9. Consumer’s Right of Withdrawal

9.1

A private individual acting as a consumer generally has a statutory 14-day right of withdrawal in respect of goods purchased from the online store.

9.2

For goods, the withdrawal period generally begins on the day on which the customer or a third party designated by the customer, other than the carrier, physically takes possession of the goods.

9.3

The consumer is not required to provide a reason for exercising the right of withdrawal.

9.4

The customer may notify Kristiina PMU of the withdrawal through the withdrawal function available in the online store or by sending a clear withdrawal notice by e-mail to:

beautypmukr@gmail.com

9.5

The withdrawal notice may also be submitted in free form, provided that it clearly indicates the customer’s intention to withdraw from the contract.

9.6

After receiving the withdrawal notice, Kristiina PMU will, where possible, send the customer confirmation of receipt of the withdrawal notice.

9.7

For a contract concluded online, the consumer must, where required by law, be able to use the online store’s withdrawal function in the same online environment in which the contract was concluded. The withdrawal function does not exclude or restrict the customer’s right to notify withdrawal by another permitted method, including by e-mail.

9.8

Statutory exceptions to the right of withdrawal apply. In particular, restrictions on the right of withdrawal may apply to products that, due to their nature or hygiene and health protection requirements, cannot be returned after the packaging has been opened.

9.8.1

The right of withdrawal does not apply to goods that cannot be returned due to their nature and that have been delivered to the customer in sealed packaging if the customer has opened the packaging.

9.8.2

The right of withdrawal may not apply to products that, after the packaging has been opened, can no longer be taken back or resold for health or hygiene reasons.

9.8.3

If a product has been delivered in sealed packaging or packaging containing a security feature, it must be possible to determine whether the packaging or product protection has been opened when assessing whether the product can be returned. Such a feature may, for example, be foil, film or another security element installed by the manufacturer on the product’s cap or closure.

9.8.4

The statutory 14-day consumer right of withdrawal does not apply to purchases made for the customer’s economic or professional activities.

9.9

If a statutory exception to the right of withdrawal applies to a particular product, the necessary information will be provided to the customer before purchase or in connection with the product.

10. Return of Products

10.1

If the consumer exercises the statutory right of withdrawal, the product must be returned without undue delay and no later than 14 days after notifying Kristiina PMU of the withdrawal.

The customer is responsible for the direct costs of returning the product unless Kristiina PMU has stated otherwise or applicable law provides otherwise.

10.3

Before returning the goods, the customer must contact Kristiina PMU by e-mail. The customer will be provided with the necessary instructions and return address.

10.4

The returned product must be packaged in a manner that helps prevent damage during return shipment.

10.5

If the product is sealed, sterile or subject to hygiene requirements, it must be returned in unopened and intact packaging if the right of withdrawal applies to that product.

10.6

If the customer has handled or used the product beyond what is necessary to establish its nature, characteristics and functionality, any resulting reduction in value may affect the amount refunded to the extent permitted by law.

11. Use of Products During the Withdrawal Period

11.1

The consumer has the right to inspect and test the product to the extent necessary to establish its nature, characteristics and functionality.

11.2

The product must not be used beyond what is necessary for ordinary inspection or testing.

11.3

If the value of the product decreases because the customer has handled or used it beyond what is necessary to inspect the product, Kristiina PMU may reduce the amount refunded to the extent permitted by law.

11.4

For sealed sterile and hygiene-related products, it should be noted that opening the packaging may, under the conditions laid down by law, result in the loss of the right of withdrawal.

12. Refunds

12.1

In the event of a valid withdrawal, Kristiina PMU will refund the amounts paid by the customer in accordance with applicable legislation.

12.2

The refund will generally be made using the same payment method that was used for the original purchase.

12.3

Kristiina PMU is entitled, to the extent permitted by law, to withhold the refund until the returned goods have reached the seller or the customer has provided proof that the goods have been returned, whichever occurs first.

12.4

If the original delivery costs must be reimbursed to the customer under applicable law, the refund will be made in accordance with the applicable legal provisions.

13. Defective, Damaged or Incorrectly Delivered Products

13.1

If the customer receives a defective, damaged or incorrect product, Kristiina PMU must be contacted:

15. Use of Products

15.1

16. Product Safety

16.1

The manufacturer’s instructions for use and safety instructions must be followed when using the products.

16.2

The customer must pay attention to warnings, storage conditions and restrictions on use stated on the product packaging or in the manufacturer’s documentation.

16.3

If the customer notices a potential safety issue with a product, use of the product must be discontinued and Kristiina PMU must be contacted as soon as possible.

16.4

For sterile products or products subject to hygiene requirements, the customer must comply with all requirements stated on the product packaging and in the manufacturer’s instructions.

17. Intellectual Property Rights

17.1

Texts, photographs, product images, logos, graphics, design and other content published in the Luxpigments.eu online store belong to Kristiina PMU or the respective rights holder, unless otherwise stated.

18. Price, Product and Availability Errors

18.1

Kristiina PMU reserves the right to correct obvious price, product and availability errors occurring in the online store.

18.2

If a product has been displayed with a clearly incorrect price or material product information due to a technical error or other obvious mistake, Kristiina PMU may cancel the order after notifying the customer.

18.3

If the customer has already paid for such an order, the amount paid will be refunded in accordance with applicable legislation.

19. Force Majeure

19.1

Kristiina PMU is not liable for delays in or failure to perform an obligation if this is caused by an extraordinary circumstance that the seller could not reasonably influence or foresee.

19.2

Such circumstances may include, for example, extensive technical failures, transport disruptions, strikes, natural disasters, actions by authorities or other exceptional situations.

19.3

In such circumstances, Kristiina PMU will endeavour to inform the customer as soon as possible and find an appropriate solution.
